Trials
Mr. Stein has a history of working with colleagues on tough cases. He is available to assist in pre-trial motions, trial preparation, and the conduct of serious trials. He has worked with many of the leading members of the bar to assist them in these areas including motions for severance, cross-examination of DNA experts, and working as co-counsel on serious cases such as murder, attempt murder, and the like.
Charter Motions
Over his 20 plus year history as a lawyer, Mr. Stein developed an in-depth understanding of motions to exclude evidence and other constitutional arguments. This includes applications to cross-examine an affiant (“Garofoli” motions”), quash a search warrant, review the manner of an otherwise authorized search, excise exaggerated or false statements in an ITO, and breaches owing to a failure to file a Report to a Justice.
One recent, novel case involved the exclusion of a statement obtained by the College of Physicians and Surgeons and five other violations of the Charter arising out of digital searches and an improperly obtained password. Given his expertise in this area, Mr. Stein has ease and facility in written documents and making an oral argument with time efficiencies based on hard-won experience and skill.
Appeals
Mr. Stein has appeared before the Court of Appeal over 50 times since his articles with Alan Gold and Michelle Fuerst. He is a member of the Pro-bono Inmate Appeals Program. He prides himself in having worked with the leading members of the appellate and trial bar on successful appeals. This includes a recent win at the Court where a Dangerous Offender designation was overturned due to a failure to provide trial counsel with an opportunity to make oral submissions. These and other cases have made the Court of Appeal a familiar venue. Mr. Stein is happy to work with you on an appeal and to help bring it to a successful conclusion.
